NOTICE OF PUBLIC HEARING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BRANDON REGARDING THE ADOPTION OF AN ORDINANCE OF THE MAYOR AND BOARD OF ALDERMEN ADOPTING A TEMPORARY MORATORIUM OF THE ACCEPTANCE OF APPLICATIONS FOR REVIEW AND/OR ISSUANCE OF LICENSES AND/OR PERMITS FOR ANY NEW BUSINESS, DEVELOPMENT, CONSTRUCTION, ADDITION OR ALTERATION WITHIN THE MORATORIUM AREA, AND ESTABLISHING AND IMMEDIATE EFFECTIVE DATE IN THE CITY OF BRANDON

Whereas, there came for consideration the question of the imposition of a temporary moratorium which would preclude the acceptance of applications for review and/or issuance of licenses and/or permits for any new business, development, construction, addition or alteration in the Moratorium Area, in the City of Brandon, with certain reasonable exceptions; and

Whereas, the Board of Aldermen of the City of Brandon find that there exists a necessity to re-plan the southeast area of Brandon in order to achieve greater economic development opportunity and higher quality development design; and

Whereas, the subject Moratorium Area is depicted on Exhibit “A” available on file at city hall and incorporated herein by reference; and

Whereas, the City of Brandon has adopted a comprehensive plan for Brandon, Mississippi.  This comprehensive planning has provided the Mayor, and Board of Aldermen with a basis for regulatory and investment decisions supporting the City’s growth and development; and

Whereas, the City of Brandon has adopted a zoning ordinance including an official zoning map which it has, with reasonable and necessary amendments, enforced, and all of which must be applied uniformly on a site specific basis to all territory within the City of Brandon and

Whereas, the said comprehensive plan and zoning ordinance require review under the circumstances to evaluate economic opportunities and growth potential in the Moratorium Area; and

Whereas, the Board of Aldermen of the City of Brandon find that additional planning is necessary to identify economic opportunities, establish appropriate design standards and coding in the Moratorium Area; and

Whereas, the applicable provisions of the Brandon Zoning Ordinance, other City Codes and existing infrastructure in the Moratorium Area do not adequately address the current planning needs of the City; and

Whereas, the City has a compelling interest in the protection of the health and safety of its residents, ensuring that the goals and policies contained within the Comprehensive Plan and other policy/planning documents are fulfilled; and

Whereas, the City determined that consideration of revisions to the City’s zoning ordinance to address the matters at issue and accomplishing this is site specific, requiring a public hearing to be  held before the Board of Aldermen can adopt the necessary ordinances to address the matters set forth herein and to assist with accomplishment of this process, the Board of Aldermen requested assistance from its advisory Planning Commission with updating its zoning ordinance and has retained a Planning Consultant to assist the Planning Commission and City Staff with this work; and

Whereas, the City determined that a temporary moratorium was necessary in order for the City of Brandon to evaluate the need for any amendment to its zoning ordinance to address the location of the stated establishments in the stated area and adopted an Ordinance effectuating the same; and

Whereas, the purpose of the temporary moratorium is to allow the City of Brandon to address the new plan in the Moratorium Area in order that the City might grow and develop in an orderly fashion in conformance with the City’s needs therein and the health, safety and welfare of the citizenry; and

Whereas, due to development pressures and requests for applications for review and/or issuance of licenses and/or permits for new business, developments, construction, additions or alterations within the Moratorium Area, a temporary moratorium is necessary within the Moratorium Area as to the stated applications and issuance of licenses and/or permits to allow sufficient time to analysis, to amend the City’s zoning ordinance and/or ordinances to address the matters herein.  Said moratorium is necessary to maintain the status quo pending completion of these steps which are prerequisite to action on this matter by the Mayor and Board of Aldermen; and

Based on the forgoing facts a public hearing is hereby set for the 4th day of May 2015, at 6:00 o’clock p.m., in the City of Brandon Board Room, 1000 Municipal Drive, Brandon, Mississippi, to consider the imposition of a temporary moratorium as set forth herein.

Until such public hearing, no permits shall be issued by the City and pending or future applicants for such shall be advised that consideration of such shall occur only after the public hearing referenced herein and after consideration of the proposed ordinance regarding the imposition of a temporary moratorium.

At the public hearing all persons interested in, affected by, or aggrieved by the imposition of a temporary moratorium as described herein shall be permitted to present testimony or evidence in support of or in opposition to the same.
